<p>Last week the Senate, Congress and President Bush approved an estimated $700 billion <span style="text-decoration: line-through;">bailout</span> rescue plan meant to stabilize our financial markets and stimulate lending between banks, and to businesses. From what I understand, the plan would allow the <span style="text-decoration: line-through;">government</span> you and me to purchase risky assets (loans) from banks. This would give banks more lending power, free up capital and make their loan portfolios contain less risk, potentially “unfreezing” the nation’s credit markets and making financial investments more stable. I have a feeling that many of the most intricate details of the plan are still unknown to most, if not all of the plan’s creators, but one thing most experts can agree on is that the plan will help prevent a worse global economic problem. Unfortunately, this is probably the first of many plans needed to undo the damage caused by many bad decisions made by citizens, institutions and the government. Most Americans won’t feel the benefits of the plan for some time, if at all, but one piece of legislation that I feel has the most potential to curb long-term damage and actually help &#8220;main street America&#8221; is a portion of the legislation known as the “Hope for Homeowners Act of 2008”.</p>
<p><em><strong>Our Nation’s Wealth</strong></em></p>
<p>It is no secret that much of America’s wealth was gained through real estate investments. Whether it was from multiple investments, or from one long-term investment made on a family home that gained equity, real estate wealth has (or had) created a retirement nest egg for many Americans.  Unfortunately, the recent recession in the real estate market has made most American’s lose fortunes in real estate.  The amount differs from family to family but there is no family in America that has not, or will not eventually lose money from this recession.</p>
<p><em><strong>The Equity Problem</strong></em></p>
<p>In the past, most American families bought a home and slowly paid the mortgage down, at the same time they typically earned equity on the value of the home. Unfortunately, nearly every home in America has decreased in value over the past 3 years; many homeowners are upside down on their homes – whether it’s $20,000, $50,000, $100,000 or $200,000 +  it’s a fact of life that many homeowners must learn to cope with. It will take several years for these homes to regain the value they lost and several more years to begin earning any equity. The losses that we are realizing today, will be felt for years to come and will make it impossible for many Americans to earn money from their real estate investment. The Equity Effect of this recession will have lasting effects on our nation’s economy, and our ability to retire. Real Estate investments that would typically provide a family with thousands in equity over several years have dwindled down to investments that may never provide a return.<br />
<strong><em><br />
The Foreclosure and Short Sale Problem </em></strong></p>
<p>Turn on your TV, flip open your laptop or open a newspaper and you are sure to stumble across something mentioning the <a title="Article about looming foreclosures" href="http://www.businessweek.com/the_thread/hotproperty/archives/2008/10/foreclosures_to.html" target="_blank">millions of foreclosures our nation’s families</a> are facing or the thousands of short sales banks are accepting. Adjustable Rate Mortgages (ARMs), subprime lending practices and other creative lending options have left many Americans with raising monthly mortgages and many lenders with risky assets. Forget about the social and economic impacts of a foreclosure on a family, and the economic impact of holding onto risky assets for lenders, and focus only on the negative impact on real estate prices, and you are still staring at a problem suitable for government intervention. No, I am not a fan of government intervention but the lack of regulation and accountability has created a problem so large that only the government could foot the bill for a solution. As long as we have millions of foreclosures and short sales affecting every real estate market across the country, home prices will not stabilize.  It is a simple fact, if homes in every neighborhood across the country are sold at a discount; those homes influence the price of all homes in the neighborhood. It is the reason why home builders attempt to offer incentives instead of price cuts, decreasing the value of one home will decrease the value of another home within the surrounding area. Until we stop foreclosures and short sales, we cannot stabilize home prices and real estate investments.</p>
<p><em><strong>The Home Builder Problem </strong></em></p>
<p>According to an <a title="Article about Construction Employment" href="http://www.builderonline.com/construction-trends/construction-industry-employed-11-million-people-in-2007.aspx" target="_blank">article on builderonline.com</a>, the construction industry employed 11 million people in 2007 (commercial and residential). This figure does not include the millions of Americans that make a substantial amount of their income from the construction industry: real estate agents, appraisers, loan officers, interior decorators, the list goes on and on. There is no doubt that the amount of workers employed by, and earning a living from, the construction industry has already decreased in 2008.  As long as this real estate recession continues, workers earning a living from the industry will continue to lose jobs and income. It is only a matter of time before many home builders, large and small, lose the constant battle to keep their businesses open. The <a title="Home Builders" href="http://www.newhomessection.com/home-builders.php">Home Builder</a> effect may not only cause millions to lose jobs, but millions more will lose fortunes in investments.</p>
<p><em><strong>The Capital Problem</strong></em></p>
<p>Millions of homeowner’s are in debt and working hard only to barely make enough money to pay their bills. As the equity, foreclosure/short sale and home builder problems continue, more and more Americans will find it difficult to pay their debts each month. The capital effect is already affecting sales of products and services resulting in less revenue for American businesses and less work for American workers. <a title="Layoff Tracker" href="http://www.bls.gov/MLS/" target="_blank">Layoffs are occurring at an alarming rate</a> and many more job cuts are expected over the next few months as American businesses prepare for what may be years of slow economic growth. In addition, the global credit crisis is making it hard for businesses and consumers to borrow money – stocks are plunging and American wealth is evaporating.</p>

<p><em><strong>The Hope</strong></em></p>
<p>The hope is in the details. Hud.gov reports that homeowners, and our nation, may find relieve from legislation within the $700 billion rescue plan. Here are the details from <a title="Hope For Homeowners Act of 2008" href="http://www.hud.gov/fha/home080730.cfm" target="_blank">the hud.gov webpage</a>:<br />
“Sustainable, Affordability Homeownership<br />
Hope for Homeowners maintains FHA&#8217;s long-standing requirement that new loans be based on a family&#8217;s long-term ability to repay the mortgage. FHA only allows owner-occupants to be eligible for FHA-insured mortgages. Borrowers must also meet the following eligibility criteria:<br />
•    Their mortgage must have originated on or before January 1, 2008;<br />
•    Their mortgage debt-to-income must be at least 31 percent;<br />
•    They cannot afford their current loan;<br />
•    They did not intentionally miss mortgage payments; and<br />
•    They do not own second homes.</p>
<p>Features of FHA-insured loans under the new program include:</p>
<p>•    30-year, fixed rate mortgage;<br />
•    Maximum 90 percent loan-to-value ratio;<br />
•    No prepayment penalties;<br />
•    $550,440 maximum mortgage amount;<br />
•    Extinguishment of any subordinate liens; and<br />
•    New home appraisals from FHA-approved appraisers.”</p>
<p>Additional information <a title="Information reseting Loan Principal Amounts" href="http://portal.hud.gov/portal/page?_pageid=73,7601299&amp;_dad=portal&amp;_schema=PORTAL" target="_blank">found on another webpage</a> within the hud.gov web portal:</p>
<p>“Affordability versus value:  lenders will take a loss on the difference between the existing obligations and the new loan, which is set at 90 percent of current appraised value.  The lender may choose to provide homeowners with an affordable monthly mortgage payment through a loan modification rather than accepting the losses associated with declining property values.”</p>
<p>More details about the plan are available on hud.gov but one mentionable stipulation is that equity gained from the sale of the home, after adjustments are made, will be split between the homeowner and lender. The amount of the proceeds from the sale that each party gets depends on how long the homeowner holds onto the property after the loan adjustments are made.</p>
<p>The Hope For Homeowners Act of 2008 is an unfortunate necessity in an era that will forever be remembered by all Americans as an era of little regulation, bad decisions and bad lending practices. If done correctly and with enough financial commitment, American families may once again realize a return on investment from real estate; foreclosures and short sales will no longer plague home prices and home builders will rebound to once again offer millions of Americans a stable income and quality investment opportunities. I can only hope that the need for measures of this magnitude will never again arise.</p>

<p class="MsoNormal">
<p class="MsoNormal">Wall Street is reeling and the Government is jumping in and attempting to save us from all the potential problems we “could” be facing.</p>
<p class="MsoNormal">
<p class="MsoNormal">All this fall out has created constant changes at Fannie Mae making it is more difficult to borrow money for Real Estate purposes than ever before.<span> </span>I am not here to judge BUT I have to give an opinion every once in a while so here it goes!</p>
<p class="MsoNormal">
<p class="MsoNormal">Looking around my Real Estate Marketplace and seeing all the troubled financial situations that have been created by shady lenders and unprofessional mortgage consultants and can’t help but wonder how this problem, being multiplied nationwide, isn’t more significant than it seems.<span> </span></p>
<p class="MsoNormal">
<p class="MsoNormal">I know that foreclosures are up and that those people in troubled loans continues to rise.<span> </span>I see my email volume increase monthly with desperate people just looking for a suitable solution.<span> </span>I am not quite sure that tightening lending guidelines is the solution here because I see these changes as making things worse not better.</p>
<p class="MsoNormal">
<p class="MsoNormal">If these rules continue to tighten we will see very few homes being purchased, banks left with enormous volumes of foreclosed properties and financial difficulties running rampant across the country.<span> </span>It’s a ripple effect, financial problems in one industry causes problems in others and yet other so on and so forth.</p>
<p class="MsoNormal">
<p class="MsoNormal">OK now that I have that off my chest here is a list of changes to lending guidelines that will have a lasting impact on the Real Estate market:</p>
<p class="MsoNormal">
<ol style="margin-top: 0in;" type="1">
<li class="MsoNormal">Unless      you have more than 25% equity in your home expect the interest rate on a      refinance to be considerably higher than someone who does.<span> </span>A three percent premium was just place      on all loans whose loan to value exceeds 75% loan-to-value.<span> </span>Even at 75% you have a minimum 1.5%      premium.</li>
<li class="MsoNormal">So you      are an investor and want to leverage your purchases.<span> </span>You are now limited to 4      properties!<span> </span></li>
<li class="MsoNormal">If you      buy a property for cash for various reasons you will now have to wait 6      months to refinance that property for cash out.</li>
<li class="MsoNormal">If you      get a loan on a property putting down 50% and want to refinance some of      that cash out, you will now have to wait 6 months.</li>
<li class="MsoNormal">If you      are looking to combine a first mortgage and a non-purchase second, a      second mortgage taken out after the purchase, you will be considered a      cash out transaction regardless of how long you have had that second      mortgage.<span> </span>Because of this you are      now limited to 75% loan-to-value on the new refinance.</li>
<li class="MsoNormal">So you      attempted to sell your home with no luck and have a need to      refinance.<span> </span>Well you now have to      wait a full 6-months even for a rate and term refinance.<span> </span>Making matters worse you are now limited      to 70% loan-to-value for that refinance.</li>
</ol>
<p class="MsoNormal">
<p class="MsoNormal">There are several more but these will give you a good sample of the Fannie Mae changes.<span> </span>I know there are those niche lenders out there who have the ability to arrange for a loan even if you don’t meet these guidelines but you can expect to pay a large premium for that loan.<span> </span>Remember Fannie Mae and Freddie Mac are the most common loans given to homeowners in the US.<span> </span>As the guideline keep tightening you can expect to have more issues with homeowners not being able to purchase of refinance.</p>

<p class="MsoNormal">As always, find a professional to work with and ask questions.<span> </span>If your representative doesn’t know the answer he or she won’t pay the consequences of not knowing, you will.</p>

<p class="MsoNormal">Now on to the new adjustments and how to work with this new rule to get what you want out of your Real Estate transaction.</p>
<p class="MsoNormal">
<ol style="margin-top: 0in;" type="1">
<li class="MsoNormal">To be      <a title="New Homes Section - Official Website" href="http://www.newhomessection.com/new-home-financing.php" target="_blank">eligible to purchase a home</a> using a <strong>FHA      loan</strong> you would need to be relocating for a new job.</li>
<li class="MsoNormal">The      new home must reside outside a reasonable distance from your current      residence and this is based upon underwriter’s discretion.</li>
<li class="MsoNormal">Must      have a full 1-year lease agreement from the closing date forward.</li>
<li class="MsoNormal">You      will need to show evidence of rental/lease by showing security deposit as      cashed and/or first months rent.</li>
<li class="MsoNormal">The      adjusted equity position in your existing home is now 75% up from 70% but      the appraisal can only be 6-months old or less.<span> </span>Now there is a small wrinkle in there      that states you can show you put a 25% down payment based upon original      purchase price but they may still require an appraisal to support the      purchase price.<span> </span>Again the      underwriter’s discretion.</li>
</ol>
<p class="MsoNormal">
<p class="MsoNormal">Now the above rules are a good start but be prepared to have your potential rental income put under a microscope.<span> </span><strong>FHA</strong> is extremely concerned about inflated rental agreements and has put in extra measures on the underwriting side of things to prevent fraud in this area.<span> </span></p>
<p class="MsoNormal">
<p class="MsoNormal">Good news is that this amount of income that can be applied to your loan application for potential rents may be increased 15% in some cases and that will really help in qualifying for your new home.</p>
<p class="MsoNormal">
<p class="MsoNormal">Just in case you missed it, there are a couple ways to play the game:</p>
<ol style="margin-top: 0in;" type="1">
<li class="MsoNormal">Add a      non-occupying Co-borrower to you loan, must be a relative, to help you      qualify.</li>
<li class="MsoNormal">Make      enough to cover both mortgage payments, current home and the new one.</li>
<li class="MsoNormal">Short      sale your home and buy before the negative reports on your credit report.</li>
</ol>
<p class="MsoNormal">
<p class="MsoNormal">As always use a true Real Estate or Mortgage Professional because what you don’t know will hurt you in the end NOT the Realtor or Loan Officer.</p>

<p>I have a property in M. CA, which I bought for $410k and now values $200k. I am thinking of the “buy and bail” option. I know it’s going to hit my credit which I am willing to take. What apart from the credit are other consequence should I look out for and can the bank come after my <a title="New Homes Section - Official Website" href="http://www.real-estate.newhomessection.com/" target="_self">new house</a>? Can they start taking income out of my paycheck? Can they put a lien on my new property? What are the tax consequences? Any help would be highly appreciated.</p>

<p>Thanks for the email and for reading my articles!</p>
<p>Just like most people in our area who bought in the past 24-36 months you are experiencing the impact of 50% decreases in the housing market!</p>
<p>Ok, so if I were in your shoes and wanted to avoid any and all consequences for “buying and bailing” I would first be sure I could buy before I even considered the “bail” side of things!  In this market banks have eliminated what you might consider normal by not allowing someone to buy unless they meet certain criteria.  Here are some points I wrote for another format but they apply here:</p>
<ul type="disc">
<li class="MsoNormal"><em>To buy while owning and renting another property you simply need      to qualify for both payments! This can be done by either having enough      income or by adding a non-occupant co-borrower on an FHA loan to buy your      new property. </em></li>
<li class="MsoNormal"><em>The other way is a bit more drastic and risky but you could sell      your home and then qualify for the new one.  This would take timing      and negotiation skills but it can be done.  Short-sale the current      home and buy the new one before your credit reflects a settled account.      (not perfect but possible) </em></li>
<li class="MsoNormal"><em>Both situations are not fraud, not illegal and pretty much moral!</em></li>
</ul>
<p class="MsoNormal" style="margin-bottom: 12pt;">Now on the consequence side of things, you really just need to be smart when “bailing” on your home.  What I mean is you need to go about it in a way that will limit your exposure to banks by actively looking for “win-win” solutions for you and the bank.  This would be in the form of a Short-sale or deed in lieu of foreclosure.  It’s very important to approach the “bail” aspect properly because if you do that you will have the highest level of success and all your concerns will go away!</p>

<p>I find the whole situation just backward.</p>
<p>Banks loaned money to people they KNEW could not afford a 800,000 house&#8230;.all hell breaks loose and now those of us who had and still have excellent credit will not be able to get a house unless we jump through hoops to get it&#8230;.we still have credit scores in the 800&#8217;s&#8230;.YES&#8230;I said 800&#8217;s&#8230;&#8230;</p>
<p>we have bought and sold 5 houses in the last few years (we moved a lot) and ALWAYS came out great after each sell&#8230;.but we have NEVER had 20% to put down&#8230;we always did around 10 to 15% then got an 80/20 for the remaining amount&#8230;.</p>
<p>we made 60,000 on our last sell and then moved back to V. and paid 382,000 for our current <a title="Townhomes by FrontierLiving" href="http://www.newhomessection.com/home-builders/frontier-living-profile.php" target="_blank">townhouse</a>&#8230;put 30,000 down, and then put 10,000 in remodeling, and we still have 20,000 in the bank&#8230;.but now unless we come up with the full 20% a bank will not loan to us?????? i just don&#8217;t get it&#8230;..</p>
<p>we are just staying here for another year and scratching the money aside so that if we do find a REO Home we really like we can try to jump on it&#8230;.there is no way we make enough money to cover two loans&#8230;..so that option is out for us&#8230;.</p>
<p>i am just sick of this whole thing&#8230;..but thank you for getting back to me&#8230;.</p>
